BMC-91 Filing: What It Is, Why It Matters, and How to Not Lose Your Authority

The BMC-91 is one of those things that seems simple until it isn’t. It’s a one-page form. It gets filed electronically. And if it’s not done right, your entire trucking operation shuts down.

What Is the BMC-91?

The BMC-91 (also called Form BMC-91) is the proof of insurance filing that your insurance carrier submits to FMCSA. It tells the federal government that you have the required minimum liability insurance to operate as a motor carrier.

Think of it as the link between your insurance policy and your operating authority. You can have both a policy and an MC number - but without the BMC-91 connecting them, FMCSA doesn’t know you’re insured, and your authority is invalid. The underlying policy that gets filed must meet the auto liability coverage minimums FMCSA requires.

Why Does It Matter?

Without a BMC-91 on file, you cannot legally operate.

FMCSA checks this. Brokers check this. Shippers check this. If your BMC-91 lapses or was never filed:

  • Your authority gets revoked (after a 30-day grace period)
  • Brokers won’t give you loads (they check SAFER/Carrier411)
  • Shippers won’t let you in their facilities
  • You could face fines for operating without valid authority

This isn’t theoretical. We see it happen. A trucker switches insurance companies, the old BMC-91 gets cancelled, and the new carrier is slow filing the replacement. For those few days in between, the trucker is technically operating illegally - and any accident during that window is a catastrophe.

The Timeline for New Authorities

Here’s how the BMC-91 fits into the new authority startup process:

  1. Day 0: You apply for MC authority with FMCSA
  2. Day 1-5: FMCSA processes your application, issues MC number
  3. Day 1-20: You need to get insurance and have the BMC-91 filed
  4. Day 20-21: FMCSA checks for BMC-91 filing
  5. If filed: Your authority becomes ACTIVE
  6. If not filed: Your authority application is REVOKED

The 20-day window is firm. FMCSA doesn’t care that your agent was slow, or that the carrier’s filing system was down, or that you were waiting for a better quote. No BMC-91 by day 20 = start over.

Who Files the BMC-91?

Your insurance carrier files the BMC-91, not you. But here’s where it gets tricky:

  • Some carriers file same-day when the policy is bound
  • Some carriers take 3-5 business days
  • Some carriers only file on certain days of the week
  • A few carriers are notorious for slow filing

Your agent should know which carriers file quickly. This matters a lot when you’re up against the 20-day window. If you buy your policy on day 18 and the carrier takes 5 business days to file, you’re in trouble.

Ask your agent: “When will the BMC-91 be filed?” If they say “I don’t know” or “it’s up to the carrier,” find a better agent.

How to Check Your BMC-91 Status

You can verify your filing at:

  1. FMCSA SAFER System (safer.fmcsa.dot.gov) - Search by your DOT number, look for “Insurance” section
  2. Carrier411 - More detailed, shows filing dates
  3. FMCSA Licensing & Insurance (li-public.fmcsa.dot.gov) - Official source

The filing shows:

  • Insurance carrier name
  • Policy number
  • Coverage amount
  • Filing date
  • Effective date
  • Cancellation date (if applicable)

What Happens When You Switch Insurance

This is the danger zone. When you change insurance carriers:

  1. Your old carrier files a BMC-91X (cancellation notice)
  2. This triggers a 30-day countdown before your authority suspends
  3. Your new carrier must file a new BMC-91 within those 30 days
  4. If the new filing is late, your authority goes into “Not Authorized” status

The 30-day overlap is critical. Don’t cancel your old policy before confirming the new BMC-91 is filed and showing in the system.

Some agents coordinate this seamlessly. Others don’t. Ask about the transition process before you commit to switching.

BMC-91 vs. BMC-91X vs. BMC-34

Common BMC-91 Problems and How to Avoid Them

Problem: Filing shows wrong DOT or MC number This happens more often than you’d think. If the numbers don’t match exactly, FMCSA won’t recognize the filing. Double-check your numbers on every document.

Problem: Gap in coverage during carrier switch Always confirm the new BMC-91 is filed BEFORE the old one cancels. Monitor it yourself - don’t just trust that it’s handled.

Problem: Carrier files late after policy cancellation If you cancel for non-payment or let the policy lapse, the carrier files a BMC-91X. This cancellation can take effect before you find new coverage. Keep your policy current, even if you’re shopping for a replacement.

Problem: Policy bound but BMC-91 not filed Having insurance is not the same as having a BMC-91 on file. You need both. A policy without a filing is useless for FMCSA compliance.

The Bottom Line

The BMC-91 is a piece of paperwork that takes 30 seconds to file electronically - but the consequences of getting it wrong can shut down your business.

Three rules:

  1. Don’t wait until the last minute to get insured (start on day 1 of your MC application)
