Why Starting a Trucking Company in New York Is Different

New York combines one of the most profitable freight markets in the country with some of the highest operating costs. Mandatory no-fault PIP insurance, the Highway Use Tax, congestion pricing, Thruway tolls, and NYC-specific permits create a startup cost profile that is 40-60 percent higher than most states. The carriers that succeed here plan for these costs before they sign their first lease.

Step 1: Form Your Business Entity

Register with the New York Department of State, Division of Corporations. Most carriers choose an LLC for liability protection. Filing fee: 200 dollars. Publication requirement: New York LLCs must publish formation notices in two newspapers in their county of formation for 6 consecutive weeks. Publication cost: 500-2,000 dollars depending on county (Manhattan is the most expensive).

Step 2: Get Your USDOT Number

Every commercial motor vehicle operating interstate or carrying hazmat must have a USDOT number. Apply through the FMCSA portal. Cost: Free. Timeline: Immediate online.

Step 3: Apply for Operating Authority (MC Number)

For-hire carriers need operating authority. File Form OP-1 with FMCSA. Cost: 300 dollars. Timeline: 20-25 business days.

Step 4: Get Insurance

Insurance must be in place before FMCSA activates your authority. New York has unique requirements.

Key Differences from Other States

  • No-fault PIP is mandatory. New York requires $50,000 PIP coverage on all motor vehicles. This is in addition to liability coverage, not instead of it.
  • Workers compensation is mandatory. New York requires coverage for all employees. There is no opt-out.
  • Disability benefits insurance is mandatory. Separate from workers comp. Covers off-the-job injuries and illness.
  • Premiums are higher than most states due to the litigation environment, urban density, and no-fault system.

Insurance Filings

  • BMC-91 or BMC-91X: Proof of financial responsibility filed with FMCSA
  • BOC-3: Designation of process agents (30-50 dollars)
  • MCS-90: Endorsement for environmental restoration (required for hazmat)
  • NYS DMV filings: Proof of no-fault (PIP) coverage required for registration

Step 5: Highway Use Tax (HUT)

New York imposes a Highway Use Tax on trucks over 18,000 lbs operating on New York highways. This is separate from fuel taxes and tolls.

  • Register through the NYS Tax Department
  • Tax rate varies by weight and fuel type
  • Must carry a valid HUT certificate of registration in the vehicle
  • Quarterly returns required
  • Out-of-state carriers must also register if operating in New York

Without a HUT certificate, your truck can be stopped and penalized at any weigh station or inspection.

Step 6: E-ZPass Setup

E-ZPass is effectively mandatory for commercial vehicles in New York. The NYS Thruway went all-electronic in November 2024, and all NYC bridges and tunnels require E-ZPass or charge higher Tolls by Mail rates.

Step 7: NYC-Specific Requirements (If Operating in the City)

  3. Get overweight permits if your GVW exceeds 80,000 lbs (NYC DOT).
  4. Know bridge and tunnel restrictions — height limits vary from 12 ft 1 in to 13 ft 6 in.

Step 8: IFTA Registration

Apply through the NYS Tax Department. Required for all carriers operating in two or more jurisdictions. Quarterly fuel tax returns.

Step 9: IRP Registration
